Ampfibian appreciates that third parties often have ideas for new products and/or services, and wish to disclose those to Ampfibian (for example in the context of suggesting a collaboration), often in an unsolicited manner.
Ampfiban only receives such information (“product/service ideas”) from third parties (“disclosing parties”) on the basis of the following conditions:
(i) The disclosing party acknowledges that it is their responsibility to protect the substance of their product/service ideas via registration of intellectual property rights prior to disclosure (for example patents or design registrations);
(ii) The disclosing party acknowledges that there is no obligation on the part of Ampfibian to treat information provided in a product/service idea as confidential; and
(iii) The disclosing party acknowledges that the disclosure of a product/service idea does not in any way prevent Ampfibian from any developing and/or commercialising products or services, including products or services described in or similar to those described in the product/service idea.
This policy protects Ampfibian in circumstances where an product/service idea relates to a product or service that bears similarity to a product or service already conceived by (and possibly under development by) Ampfibian.
